1. Who We Are?

AVATAR NOTARY PUBLIC is a professional public official who have be granted a delegation of authority from the Royal Government of Cambodia of the Kingdom of Cambodia through a Sub-Decree No. 49 dated April 8, 2020 to complete the following works:

  • Provide authenticity to any contract or legal document of a private individual,
  • Confirm the true nature of the correct signature,
  • Ensure the date,
  • Record and deposit the legal documents, and
  • Issue a true copy of the original documents that must be certified.

AVATAR NOTARY PUBLIC carries out their profession in exchange for charging fees from clients who come to the notary service. However, as a public official, we oblige to provide unbiased advice and to prepare the legal document to any party as well as to protect the public interest of the State.

To complete this work, we would rely on important laws such as the Code of Civil Procedure, Civil Code, and the Law on Civil Procedure. Since the notary profession is a neutral profession in protecting the public interests of the State and the private interests of the parties, we would like to make a presentation and find out what vital roles notary play in the legal field of the Kingdom of Cambodia.

2. What are the duties of a notary?

Notary is only obliged to provide legal advice based on law in force. Notary could be biased in the interests of either party. Notary shall ensure neutrality, which protects the interests of the parties and the legitimacy in accordance with law in force. Notary could have the duty to clarify and explain to the parties the rights and obligations set out in the contract as well as the legal effect of their contract before the parties sign or fingerprint it. Before giving authenticity to each letter, the notary shall ensure the accuracy and verification of the identity of the parties and the will of the parties. All documents prepared by the notary as well as all legal documents intended by the private individual to be kept at the notary public must be kept for at least 40 years. Upon request, notary may issue a true copy of the original letter or document and have the same legal effect as the original of letter or document.

3. What are the roles and duties of a notary in real estate sector?

Notary could formulate various types of contracts related to real estate such as the transfer of ownership of real estate through the sale, exchange, inheritance. Notary could arrange other real estate agreements such as usufruct, easement, perpetual lease and security agreements (including mortgages, mortgages).

4. What are the roles and duties of notary in social affairs, family and marriage?
  • Notary could provide unbiased advice and formulate nuptial agreement, gift, inheritance by authentic deed, inheritance by secret letter, and legal technical work related to succession.
5. What are the roles and duties of notary in business sector?

Notary could provide unbiased advice and formulate letters or commercial contracts such as power of attorney, business establishment contract, joint venture contract or legal documents on business relations between businesses and investors and other business matters involving the transfer of shares, the appointment of shareholders and / or the Board of Directors, the issuance of certificates on the legal documents of the parent company and / or its subsidiaries.

6. What are the roles and duties of notary in intellectual property?

Notary could provide unbiased advice and prepare letters or contracts related to the intellectual property, record and maintain the letter of authorization of exclusive import of branded products. Notary would certify the authority of the signatory on behalf of the delegate in the form of a written agreement by the parties. Notary could also prepare a number of intellectual property documents such as a power of attorney, mandate, a letter of appointment, and/or termination of trademark rights.

7. How is a notarial letter enforced?

Notarial Deed could be the notarial authentic letter or notarial certified letter. Both types of deeds are supposed to have higher witness power than private letters, namely:

  • Letter with final date, and
  • Letter that can be enforced if the letter meets the requirements of the law in force.

A Notarial Letter that meets all the requirements of the law is a letter that can be enforced immediately without having to go through the decision of the competent court on the merits.
